Sucre, 30 de diciembre de 2024.- El Fiscal General del Estado, Roger Mariaca Montenegro, al referirse al caso que se investiga en contra del expresidente de Estado, Evo Morales Ayma y otra persona, se\u00f1al\u00f3 que el Ministerio P\u00fablico ya emiti\u00f3 imputaci\u00f3n formal por el delito de Trata y Tr\u00e1fico de Personas que radica en el departamento de Tarija y que la audiencia de medidas cautelares est\u00e1 fijada para el martes 14 de enero de 2025 a horas 09:30, as\u00ed lo dispuso la autoridad jurisdiccional.<\/p>\n\n\n\n

\u201cDesconoci\u00e9ndose el paradero actual de los imputados y tambi\u00e9n de la v\u00edctima, conforme establece el art\u00edculo 165 del C\u00f3digo de Procedimiento Penal notif\u00edquese a trav\u00e9s de edictos, el cual deber\u00eda de ser publicado en el portal electr\u00f3nico del \u00d3rgano Judicial y del Ministerio P\u00fablico emplaz\u00e1ndose a los imputados a comparecer ante la autoridad jurisdiccional\u201d, dijo Mariaca a tiempo de dar lectura a lo que se\u00f1al\u00f3 el juez cautelar.<\/p>\n\n\n\n

Asimismo, indic\u00f3 que la Comisi\u00f3n de Fiscales que lleva adelante esta investigaci\u00f3n a la cabeza de la Fiscal Departamental de Tarija, de acuerdo a la ampulosa imputaci\u00f3n formal que se present\u00f3, est\u00e1n solicitando la medida excepcional de detenci\u00f3n preventiva para ambas personas en una c\u00e1rcel p\u00fablica del pa\u00eds.<\/p>\n\n\n\n

El Fiscal General aclar\u00f3 que el juez al momento de instalar la audiencia de medidas cautelares, en presencia de la Comisi\u00f3n de Fiscales y las partes procesales, considerar\u00e1 si existen indicios de las personas, los riesgos procesales de fuga y obstaculizaci\u00f3n y otros elementos que ser\u00e1n dispuestos por la autoridad jurisdiccional.<\/p>\n\n\n\n

\u201cCuando un imputado es notificado de manera legal conforme a procedimiento y no se constituye y tampoco argumenta la inasistencia a esa audiencia de medidas cautelares, de manera documental y legal, el procedimiento en sus art\u00edculos 87 y 89 del C\u00f3digo de Procedimiento Penal es claro y habla de la rebeld\u00eda que dice que tendr\u00e1 que librarse, esta vez, ya es orden de aprehensi\u00f3n, mandamiento de arraigo y otros que est\u00e1n estipulados en nuestra normativa procesal penal, en ese entendido, ya es un trabajo del \u00d3rgano Judicial\u201d, aclar\u00f3 Mariaca.<\/p>\n","protected":false},"excerpt":{"rendered":"
